Please read these terms and conditions (“Terms”, “Terms & Conditions”, “T&C’s”, "Policies") carefully before purchasing any items from https://www.waterworthcreations.co.uk website.
By agreeing to these Terms you hereby give your consent to enter into a contract with Waterworth Creations whereby you are the Buyer and Waterworth Creations is the Supplier.
1 . DEFINITIONS
Buyer means the customer, specifically “You” the individual who is making the purchase and agreeing to the terms
Terms means the agreement which governs the purchase order between the buyer and the supplier
Supplier means Waterworth Creations referred to throughout this agreement as (“Us”, “I”, “We” or “Our”)
Products are the items for which the buyer is entering into the agreement with the Supplier to purchase using the website
Warranty the amount of time the buyer has to return an item for a refund or exchange
Processing time the amount of time it takes to create/make a product
Delivery time the amount of time it is estimated it will take the item to reach the buyer after processing time
2. GENERAL
2.1 You may use this website to browse and purchase the products shown. You must do this in a way that does not infringe upon our intellectual property: therefore copying, reproducing, altering or otherwise using any content of this service notwithstanding the images in listings, without first getting prior consent from us is prohibited.
2.2 Waterworth Creations website is hosted by Squarespace and therefore uses several third party sources that may also use cookies and data for their own purposes. This is not related to Us and we will endeavour to inform you of everything we know about.
2.3 We may revise these terms of service at any time and the revised document will be effective from the date it is published on our webpage and updated anywhere else it appears.
2.4 We as the supplier agree to deliver products as described in your purchase order within the timescale specified ( refer to clause 4 for delivery information)
2.5 We omit glitter from near the rim of each drinking glass we produce for the safe use of our customers when they use our glittered glasses
2.6 All colours displayed on the Buyers’ screen may differ from that of what is actually received. This is due to the differing devices used to view the website on and the pixels in each of those devices. We will always try to match the colour correctly but this may not be a perfect match. It is at the discretion of Us as to whether an item is returnable due to the colour match not being satisfactory. Our decision is final.
3. CANCELLATION and RETURNS RIGHTS
3.1 Buyers have the right to cancel an order at any time prior to shipment of the goods and will not be penalised for doing so.
Personalised items are exempt from this rule as they have a no cancellation policy unless damaged in transit/faulty on arrival. (see also clause 9.6)
3.2 Buyers have 14 days to terminate an order from the date it was delivered by the courier/received by the customer. The Buyer must send an email to Us within this specified time frame of 14 days and the Buyer must await a confirmation of a return acceptance before sending any items back to Us.
3.3 Items damaged in transit or faulty on arrival with Buyer will be subject to photographic evidence being supplied for a refund to be accepted. The Buyer must notify Us within 48 hours of the order being delivered/received.
3.4 All returns must be sent back within 14 days after a return acceptance has been agreed and original packaging must be used for the return.
3.5 Buyer must initially pay return postage and will be compensated should the product be deemed faulty/damaged in transit. Proof of postage is not a guaranteed refund as most returns will be subject to inspection upon being received by Us; furthermore any damage thought to be malicious and not done in transit or faulty upon arrival to the Buyer will NOT be refunded.
3.6 If the buyer changes their mind about an order after it has been shipped then the buyer must pay for the return postage and Clause 3.2 and 3.4 apply.
3.7 Any return executed by the Buyer after the 14 days cancellation and notification period will be subject to an entitlement of a partial refund only or an exchange. The decision We make is final.
4. DELIVERY
4.1 We use Royal Mail as our main courier service and both our 1st and 2nd class postage methods are of a signed for method with the courier. Therefore the Buyer will be supplied with a reference number which will show when the order was posted and if any attempts of delivery have been made and when the item was delivered.
4.2 Shipping times are out of Our hands once posted and therefore timescales are hard to state. Please refer to Royal Mail website to determine any local delays in your area that may interfere with delivery.
- 1st class is an estimated delivery timescale of 1-2 working days
- 2nd class is an estimated delivery timescale of 2-3 working days
4.3 Claims for lost or missing parcels are only accepted if the parcel has not arrived 10 working days after the due date; example Posted on Monday 1st class, Due by Wednesday same week, not classed as missing or lost until the Wednesday 2 weeks later, this is due to Royal Mail’s timescale.
- However, We do want you to contact us immediately if the order has not arrived within the specified timeframe from Royal Mail so we may log it straight away and also keep our eyes on the situation.
4.4 We may from time to time and without notice change our courier if we feel the need to in order to keep as close to our timescales as possible for the Buyer.
5. PROCESSING TIMES
5.1 Most of Our products are made to order as they require some form of input from the Buyer. Our products are all hand created and hand decorated and therefore take a lot of care and skill to get to the end result. Thus meaning that each individual item takes time to make before We ship it to the Buyer.
5.2 The more elaborate the design on a product the more time it takes to create, so for this reason our timescale for items will be posted on each listing in the description section.
5.3 Without prior warning at busy periods our timescales may be subject to change. We will endeavour to inform you of such changes but may not always be possible to do so.
6. PAYMENTS and PRICES
6.1 All payments are accepted through a third party site such as Zettle or PayPal. Both of which will be subject to their own data/GDPR policies as well as any cookies that may be linked to their sites too.
6.2 Any payments errors that occur when using the third party site are NOT anything to do with Us and will therefore need reporting to the third party company. We ask that you do inform Us though in case of the third party company being unreliable.
6.3 Product prices shown on Our website are final and subject to changes when necessary and without prior warning.
6.4 If a product price on the Buyers order has encountered an error We may terminate the order and refund the Buyer with an explanation as to the error that occurred with no obligation to fulfil the order as the price error encountered is subject to further investigation.
7. AFTERCARE
7.1 All Our glittered items are supplied with a set of care instructions for each individual product ordered. This is to ensure that the Buyer/End User has the best knowledge to ensure the product remains at its best.
8. PRIVACY POLICY (GDPR)
8.1 We collect general data from all Buyers for the purpose of fulfilling the order placed. The Buyer is asked to provide their Name, Number, Email and Address in order to use for shipping the order to them.
8.2 The Buyers details will be kept in accordance with the government law to ensure the information for accounts and other necessary documentation in line with the business taxes is adhered to.
8.3 Waterworth Creations website is owned by Lisa Waterworth and hosted by IONOS. IONOS are therefore a third party and hold their own policy in regard to data protection and privacy. The information they retain about the Buyer is not therefore the responsibility of Waterworth Creations. We will ensure that upon a potential Buyer accessing their website; they are informed of the potential for cookies on the webpage.
8.4 We will use third party websites and couriers in order to fulfil the Buyers’ order. Henceforth the data shared with Waterworth Creations in regard to that in 8.1, will be shared with these third parties and used by them in accordance with their own privacy policies.
9. PERSONALISED/CUSTOMISED ITEMS
9.1 We require information from Buyers when they request personalisation on an item that offers it. In regard to this personalisation it is the Buyers’ responsibility to ensure the correct spelling of all details at the time of ordering
9.2 All mistakes made on the part of incorrect spellings at the fault of the Buyer will NOT be refundable. The discretion of Us is final in terms of whether a discount on a repurchase is offered due to the mistake made.
9.3 If a mistake in spelling is made by Us then we will replace the item free of charge. A refund will only be offered in extreme circumstances. The original item may need to be returned to Us for correction in some cases. If this is required We will let you know and will pay for return postage back to Us; this may need to be purchased by the Buyer initially and refunded once proof is received by Us.
9.4 Customised items are those which require the Buyer to choose certain aspects to include in the design. Any mistakes on the part of the Buyer in choosing the correct combination of customisable design elements will NOT be refunded. A discretionary discount may be offer in some circumstances.
9.5 Customised mistakes made by Us will be subject to the same rules as personalised items in clause 9.3
9.6 ALL customised and personalised items are NON-returnable and are exempt from all returns unless they are damaged in transit or faulty on arrival in which case please refer to clause 3.3-3.5
10. PROMOTIONS
10.1 From time to time We may run some promotions that give the receiver a reward; usually in the form of money off items purchased. These promotions are subject to Our discretion and may be withdrawn at anytime without prior warning.
10.2 From time to time We may give a specific reward code to Buyers/potential Buyers; of which they must NOT be given/transferred to anyone else. Anyone caught transferring their reward code to another person will not have their reward honoured.
11. COMPLAINTS
11.1 All complaints must be sent via our online form
11.2 All complaints will be dealt with in a timely manner and We will endeavour to respond within 14 days to a formal complaint
